The dominant social scientific approach to studying judicial behavior treats judges as strategic actors pursuing their political preferences under institutional constraint. The intellectual roots of this rational choice approach are in American law’s long but sporadic engagement with pragmatist ideas. This article challenges that approach: a fully pragmatist account of judicial action provides a better description of the intellectual and social work of judging, and better explains how judges reach a decision in difficult cases that most affect the development of (...) law and its relationship to society. The article argues that the foundational intellectual problem for appellate judges is how to define the legal questions presented in a case. Definitions of legal questions arise from the interplay of habitual and creative action in the local social context of an appeals court. Professional and local interpretive habits and legal forms ordinarily do a great deal to define the key questions, which are not strictly determined when a case comes before a court. Unscripted small group interactions at oral arguments also figure in question definition; oral arguments are most important in the rare but legally important cases where habitual practices alone are insufficient to delimit the legal question judges must answer. Supported by extensive interviews with federal appeals judges and clerks, the article illustrates judges’ creative, interactional efforts to define an answerable question in a major asylum case decided in the Seventh Circuit Court of Appeals. Building from this case, the article describes the factors that shape judicial question definition, and describes the conditions when creative judicial action is likely to be most prominent. We desperately need to know more of the biological details of the onset and progression of breast cancer. The disease is of startlingly high incidence (approaching 1 in 9 women), our current therapies for the disease are inadequate once it has metastasized, and the disease is characterized by excessive morbidity and mortality.Most of the growth and differentiation of the mammary gland occurs relatively late in life: during sexual maturation, and then cyclically during pregnancy and lactation. Normal as well as malignant (...) growth is regulated by endocrine hormones as well as by local tissue factors, such as polypeptide growth factors, Cancer seems to progress as hyperplastic ductal or lobular epithelial growth, acquiring progressive genetic changes (including those of oncogenes and tumor suppressor genes) leading to clonal outgrowths of progressively more malignant cells. The nature of proliferative controls and the relevant genetic changes are the subjects of the current review. (shrink)

This paper is a critique of a paper by Robert Lipkin [1]. Arguments for the following claims are put forward: (1) that what is essential to the psychiatric relationship is what we want it to be for utilitarian reasons; (2) it would not be to our advantage to allow the medicalization of morality; (3) what we should expect from the psychiatrist is prudential advice, not moral advice, and that Lipkin has a confused view about the relationship between these two areas; (...) and (4) we should not allow the psychiatrist to restrict individuals on moral grounds, but only on public safety grounds. What sort of thing is judgment?1 Looking at the sense of "judgment" as a human capacity as opposed to the result of exercising that capacity, whether in ordinary behavior or in some legal or political framework, I intend to offer a definition proposal for the term and then to discuss how judgment so defined operates in human behavior, what constitutes good judgment, whether it can be cultivated, and, if so, how. The example I will focus on is drawn from Shakespeare's (...) character Benedick in Much Ado About Nothing as he decides to fall in love with Beatrice. Postulating that Shakespeare is a shrewd analyst of human psychology, I hope to show that his portrayal will illuminate the concept of judgment and, conversely... (shrink)

Friedrich Nietzsche is one of the most elusive thinkers in the philosophical tradition. His highly unusual style and insistence on what remains hidden or unsaid in his writing make pinning him to a particular position tricky. Nonetheless, certain readings of his work have become standard and influential. In this major new interpretation of Nietzsche’s work, Robert B. Pippin challenges various traditional views of Nietzsche, taking him at his word when he says that his writing can best be understood as a (...) kind of psychology. Pippin traces this idea of Nietzsche as a psychologist to his admiration for the French moralists: La Rochefoucauld, Pascal, Stendhal, and especially Montaigne. In distinction from philosophers, Pippin shows, these writers avoided grand metaphysical theories in favor of reflections on life as lived and experienced. Aligning himself with this project, Nietzsche sought to make psychology “the queen of the sciences” and the “path to the fundamental problems.” Pippin contends that Nietzsche’s singular prose was an essential part of this goal, and so he organizes the book around four of Nietzsche’s most important images and metaphors: that truth could be a woman, that a science could be gay, that God could have died, and that an agent is as much one with his act as lightning is with its flash. Expanded from a series of lectures Pippin delivered at the Collège de France, _Nietzsche, Psychology, and First Philosophy_ offers a brilliant, novel, and accessible reading of this seminal thinker. This 2002 book was the first English translation of Friedrich Schleiermacher's mature ethical theory. Situated between the better-known positions of Kant and Hegel, Schleiermacher's ethics represents an under-explored and singular option within the rich and creative tradition of German idealism. Schleiermacher is known to English readers primarily as a theologian and hermeneuticist, but many German scholars have argued that it is in fact his philosophical work in ethics that constitutes his most outstanding intellectual achievement. The lectures, which were not published (...) in his lifetime, are thought to span the years 1812–17 and address such topics as ethics as a descriptive science, ethics as a study of the action of reason on nature, and doctrines of goods, virtue, and duties. This volume presents them in an accessible new translation by Louise Adey Huish, together with an introduction by Robert Louden that sets them in context and assesses their achievement. (shrink)

'Modernity' has come to refer both to a contested historical category and to an even more contested philosophical and civilisational ideal. In this important collection of essays Robert Pippin takes issue with some prominent assessments of what is or is not philosophically at stake in the idea of a modern revolution in Western civilisation, and presents an alternative view. Democracy is not only a form of government. It is also the moral aspiration for a society of self-governing political equals who disagree about politics. Citizens are called on to be active democratic participants, but they must also acknowledge one another's political equality. Democracy thus involves an ethic of civility among opposed citizens. Upholding this ethic is more difficult than it may look. When the political stakes are high, the opposition seems to us tobe advocating injustice.
